Accident investigation and safety reps - injureds consent

One of the defined functions of safety reps is to participate in accident investigations. However, Reg 7 (2)(c) of SRSC regs, states that information relating specifically to an individual may not be given to a safety rep without the individual's consent. Our legal team advise that we therefore cannot tell the safety rep the name of the injured person without first getting the injured person's consent, which can be impractical if the person is off work; however the safety rep can't really participate in an investigation without knowing who was injured! How have other members handled this?
