The safety implications of seconded employees

A member company recently hired out an employee to a company where he sustained a severe injury. The employee brought a case against the hiring company which was ordered to pay substantial damages. The hiring company appealed and the Judge changed the decision, ordering the employer and hirer to share the costs, paying half each.


The employer knows it has ultimate responsibility for its staff but wonders how it can control risks of long term secondments - or via contractual method define the line of responsibility , to ensure that the hiring company takes full responsibility in the case of an injury and subsequent claim.
