Defining home working

Our safety team take the line that any working from home that is a regular occurance or predictable as recurring should be seen as home working. However, our flexible working group take the line that if there is no formal agreement in place then it is not home working - so it is acceptable for individuals to work from home for 2 or 3 week spells or 2 or three days a week without any type of assessment as long as there is no formal agreement in place.
Can any members provide some guidance as to where a clear definition for home working can be found?
