Re-employing the accident-prone.

We are recruiting for staff and some of the applicants have previously worked in the company. Unfortunately some have a long history of accidents and claims against the company. Obviously we cannot discriminate against any person, however, as we have a duty to our existing workforce to their health and safety can we take their previous known history as part of the selection process?
