Question 44 January 2001

Litigation against an on-site trainer

Does anyone know of the cases outlined below?

One of my Team Co-ordinators - a Vehicle Instructor for 10 years - informs me that he will not seek to renew his licence this year due to his fear that he is personally liable in a court of law if a serious accident occurs.

Two instances of this nature have been relayed to him, one resulting in an Instructor losing his house via litigation.

Does any member know the details of either case? I would be grateful to know more about the individual circumstances.

If his fears are groundless then such a rumour should be nipped in the bud, lest we end up in a situation whereby we have no Vehicle Instructors.
